Our MLS has allowed "equitable interest" entries for years. I suspect most do allow such these days. Ask an experienced agent, the average agent won't know what in Hades the term means. IMO:)

I've done hundreds of short sales for people in all kinds of situations. 100% of the sellers were glad they were able to do the short sale. As Jon mentioned, sell at a loss, the capital loss should offset the debt forgiveness. The person that mentioned the insolvency issue is right on. Consult a CPA, but 99% chance you should do it.

Hire an experienced CDPE Realtor. Do yourself a favor and do not list with a non-CDPE. IMO:)

Disturbing. No matter how hard of a financial devastation one could have, holding onto their law/real estate broker licenses should have been paramount. One can always rebuild. IMO...*sigh...

David Beard Joseph Sweeney Steven Hamilton II If the seller won't provide a Schedule E, base your price on the worst possible scenario.

A seller will gladly provide them or they're flat out lying on the Schedule E and/or to you about the numbers. An agent that doesn't get them with their listing forms is incompetent and/or inexperienced in selling investment property.

David Beard is right. There is no credit bureau report unless the payment isn't posted until the following month (IE: ensure it's posted by the last biz day of the month). There is zero reason to put yourself through the stress, make the payment. Interest is billed per diem, not monthly.

Sean D Interesting concept, but the short answer is "probably not feasible."

I recommend you list the units with a property manager to put in the MLS, put up a sign. If you just want them to bring you a tenant, you can pay one month's rent in most cases. You can use their forms, or some brokers will use any form that looks good for them to use.

We have a maintenance person on our staff. If he opens a rental of mine and collects the application fee, we give him the application fee as a success fee (on top of his hourly wage of course). Florida Law won't allow us to pay a non agent for procuring a tenant. They can be paid a fee for showing the unit, but it can't be tied to a lease. Good luck.
