Most rentals I have bought were in poor condition with code violations.. Or sometimes I also had to pull permits to remedy the violations... It always stood up in court for me showing that a code inspector had just signed off on the property, or a bulging inspector... Given that thought, perhaps you can ask a code enforcement agent to walk through the property to make sure it satisfies minimum housing code... Not saying this is foolproof, but it should help in court.. Beware though, they may find things to fix that you didn't know about!!

Hey Nathan I've never heard of a notice fee, and I'm not sure if that's even legal where I am... Rent is due on 1 and late on the 2nd.. Can't charge a late fee until the 5th.. But they're late on the 2nd, so thats when I drop off my ten day notice... That way I can evict as soon as possible if they're not going to pay.. I had some tenants keep running late and waiting for naive agencies to pay their rent.. I ended up not taking that money anymore and evicted them....

as far as representing in court, here in charlotte, we can represent our own LLC in small claims court, provided you're a member of the LLC...never been asked to show proof of that...one judge asked me straight up once bc i was filing evictions for different buildings that were in different LLC's, and so she just wanted to make sure I was a part of both LLC's..anyways, once the tenant appeals to district court in my area, you do have to get an attorney

unfortuntately, i predicted this as i read your thread....best policy i have is to go ahead and evict..and tell tenant, i'm happy to work with you, provided you pay all debts, late fees and court costs before court date...(even after court date, they have 10 days before i can file a writ to have sherriff lock out, so even then, you could technically still work with them)....that gives them enough time to get their butt in gear or go to some agency that helps them with rent...it seems my tenants love getting 10 day notices on their doors bc they take them to agencies that pay their rent....

i used to have tenants deposit into my account...they had to write the building and apt. # somewhere on the receipt..never had problems like this and was easy to identify who paid late, partial, etc.

i have since found it's easier to just set up a mailbox..i went to a small mom and pop packaging store here...it's in a convenient location on the bus line, and near most of my properties...they'll allow tenants to come in and hand them 'mail' for my box..of course it's rent payments, but they still put in an envelope so nobody snags the money order...if it's a partial payment i return it and don't issue a receipt..if it's a full payment, i drop off a receipt..i go out once a week to drop off receipts...efficient? maybe not, but it keeps me in control! :)

Welcome Keela..my answer is simple..if you do what you say you're gonna do people will respect that...i started young, and still look like i'm 16 when i shave btw..some people looked at me funny at first, and some still do..but when someone needs to sell a property, and you're there to buy it and close, they'll respect it and come to you again, regardless of age..similary, if they see you building a reputable portfolio of rentals, or a successful flipping business, they'll repsect that as well..i do honestly think it's a bit tougher for a younger person to earn that respect, but you can make it a lot easier on yourself by following through with every little thing....return phone calls, christmas cards to attorneys, lenders, etc. thank you cards..whatever it is...good luck :)
