Hey Chris - it is excluded. The updated legislation in 2018 "exempts single family dwellings with an Accessory Dwelling Unit and a single rental unit in a condo, co-op or homeowners’ association."

House hacked a 2 unit duplex in NW DC. I short term lease the basement unit and rent out 3 of the bedrooms in the upstairs unit where I live (I live in the 4th bedroom).
