@Jill F. Just wanted to say thank you for being kind enough and having the courage to post your letter. While there is criticism of it as I’m sure you expected there may be, there are others who have been appreciative of it, me being one of them.

I’m still pondering whether or not to send a letter to my tenants and what to say. Nonetheless I appreciate you posting your letter and thoughts, gives Newbie investors like myself something to think about. Always appreciate your insight. You’ve posted a few times on my threads and just thought you might like to hear it’s appreciated after the bit of backlash you got on here. Criticism is not necessarily a bad thing, as long as it’s constructive. And there’s a couple folks that could use to keep that in mind when replying ;)

@Sue K. I certainly don’t consider it a waste of money. Do I want to have to spend it? Absolutely not, but I’d far rather spend the bit of money I’m having to so I do things properly, cause otherwise it could end up more costly in my opinion.

I have served him notice at this point. Hand delivered a 5 and 30 day notice and sent copies of them via certified mail. My lawyer didn’t make it complicated at all, he’s a pretty straightforward guy. Sounds like maybe you haven’t had the best of experiences with lawyers maybe?

I definitely appreciate the insight on if I did something wrong with documents they would tell me how to do it correctly. That’s definitely good info to know. I didn’t want to have to learn about all of this so quickly, but hey I’m getting a crash course on it all right now, which will I’m sure pay off more down the road considering I will already know the steps now and can avoid further being “ripped off”

@Crystal Smith thank you for the response. I did send them a letter when we took over ownership to the property, just didn’t feel it pertinent to my question. The cash for keys would basically be his security deposit. You think I should offer more? Any other strategies you suggest?

I have hand delivered a 5 and 30 day notice at this point. A certified letter is currently in the mail. The tenant claims he’s going to pay and has until Monday, so we’ll see. I’m still optimistic, but have things rolling the way I’d need if it gets to that point according to the advice I’m receiving from my lawyer

@Dan Heuschele that is actually exactly my plan! As we speak I am currently headed home to get said 5 day and 30 day notices typed up and I will be stopping by his residence tomorrow to try and find out what’s going on. Definitely plan to be nice and hopefully he pays, but if not he will be getting served 5 and 30 day notices Per my lawyers recommendations!

Contacted my lawyer, he recommends serving him both a 5 day and 30 day at the same time. If he pays go ahead and get a lease signed, if not serve him the notice. Thanks everyone for the replies and advice. Any other thoughts, tips, or kind words are welcome too :)

@Michael Noto thank you sir, good insight. Sounds like I’m on the right path. To this point I’ve done the items you outlined, Except for the last pieces of course with regards to serving him notice. Sent them a welcome letter with all my contact info and I’ve offered multiple ways to pay as well as options in collecting it, including me coming down to collect.

I guess at this point we will see if he pays today. I am due to stop by my other tenants residence tonight for another item of business, so I plan to knock on his door this evening to try and find out what’s going on if he still has not paid by the end of the day and see what we can do to move forward. I’m going to have my five day notice in hand if I need it. Hopefully I get the chance to speak with my lawyer as well today

@Mary Mitchell goes on to say if tenant is in default landlord shall have the right to terminate this residential lease agreement by giving the tenant a 3 day notice

@Mary Mitchell current lease shows “Tenant will be in default of the residential lease agreement if he/she 1. Fails to pay the full rent when due”

So technically he’s in default, which should allow for breach of lease, correct?

@Mary Mitchell agent was the seller, no agent was technically involved. March 2 was Monday and he said they usually paid on Monday when rent was due on the 1st and it was the weekend

I’ve reached out to them both via text and a letter giving them contact info and options and ways to pay as well. He definitely has the info, I emailed him the lease as well which per our conversation ended up being the way he preferred after he avoided meeting in person. I’m leaning toward showing up in person with a copy to have signed as well. Any other thoughts or tips? Appreciate the help
