@Russell Odom's suggestion to open a dialogue with the builder about your situation. If you'll PM me the builder and the particular development, it's likely that someone at my brokerage has a relationship and could make a call on your behalf.

The City of Austin just published a website to compare zoning updates proposed under CodeNEXT to existing zoning.

Texas Senate Bill 451 just passed the upper house in a 21-9 vote. The bill would roll back local regulations of short-term home rentals recently enacted in cities such as Austin, San Antonio, and Fort Worth. The companion bill, House Bill 255, is currently working its way through the lower house. Yes, I actually have a client who was looking to buy a small home on a large lot in order to construct/install an accessory dwelling unit (ADU). However, he changed strategies last month when we got him under contract on a larger single family home in East Austin that he couldn't pass up. He's going to do a live-in rehab on a conventional loan with a lender who will allow him to escrow funds for rehab/repairs at closing.

According to the current ADU ordinance in Austin, you need a lot of at least 5,750 sqft. (~0.13 acres). The ADU itself cannot be larger than 1,100 sqft. or 0.15 FAR, whichever is smaller. There are other requirements and rules, which you can explore here. The whole ordinance is here.

There are a few modular/pre-fab ADU designers and builders local to the Austin area. Here is an example of Ma Modular's work. You can also check out Kanga Room Systems.
