I appreciate all your replies. I successfully gotten rid of her things and now looking to renovate and sell or just sell. Is cash for keys generally speaking a low ball offer? Also has anyone have good experience with DST 10/31 or REIT 10/31? Pros seem to be very passive, con is illiquidity.

I appreciate everyone’s feedback. I may not have been clear. I’m not throwing anything out within her apt. That is until she is legally evicted. The areas I was referring to was areas that don’t fall within lease. A garage, backyard and basement which I’ve told her she was not to use but used illegally anyway. I’m cleaning out the first floor vacant apt and while I have dumpster I want to clear out those other areas. I don’t know if those items are all hers or the other tenants who moved out last month. I sent a letter to tenant still there that I will remove all items that are still in those areas which weren’t even allowed to be used in first place. Now I’m junking it all. I will start eviction process to remove her now since she is in arrears for a few months. I don’t think to the gentleman’s point that I’m in any danger for any legal action against me.

Appreciate the replies, James I’m moving towards your mindset. She has no real place to store these items, which is mostly junk. She never had rights to put them there in first place. I need to clean up and renovate.

Hi, I have a two family property that I bought for foreclosure in 2010 for $215,000 fixed it up for $80,000. Since invested another $30,000. I have it rented as section 8. My non paying tenant moved out so now have to renovate and sell or re rent. The existing tenant is a hoarder. Has used the basement, shed/garage and driveway for her things. None of it is addressed in lease which has expired. She is also in arrears $2000 of her portion of rent. I sent her a letter to have everything removed or I will throw away. I have been neglectful of place since I moved away and have a young family and preoccupied. Am I in clear to just take everything to dumpster? The rent roll is 6k a month if both apts are rented. Section 8 covers about 5k. I usually have issues getting the amount tenant pays. I think I’m looking to just renovate and sell. I don’t care for being a landlord anymore with having a young family, work and living away from place.
