Post: Apartment Building Syndications and 1031 Exchanges

I have been a Limited Partner (LP) on several apartment building syndications.  I have been told that as a LP that I cannot participate in a 1031 Exchange when that apartment building is sold.  I was wondering does the same apply to General Partners (GPs) or can GPs participate in 1031 Exchanges?

Hello Bigger Pockets,

I was wondering whether my self-directed HSA would incur UBIT in the

following scenario:

There will be a conventional loan (i.e. a bank) in first lien position.

My self-directed HSA will be in second lien position. My self-directed

will be a straight debt lender and will charging points and a % per annum

let's say 2 points and 12% per annum.

Will my self-directed HSA be subject to UBIT?

If not would you explain why?

You had said regarding this experience with Dustin Rose: This has taught me what additional measures to take to protect myself when lending.  I was wondering what specifically has this experience with Dustin Rose taught you?  What "additional measures" would you now institute? Has anyone out there set up a HELOC on their primary residence and then use that HELOC money to private lend to real estate investors? If so how is it working out for you?
