Well $hitfire!   Wouldn't you know the case is not dead (no pun intended) afterall.  The gutter scum bottom feeding attorney for the apartment complex has managed to somehow get the case put back on the JP docket for their counter claim.  Both cases were dismissed 2+ years ago for lack of standing. There was no probate opened because there was no estate.   My guess is that the gutter scum bottom feeding attorney which represents the landlord that steals from the dead & the property owner is milking them for everything he can. The counter claim was for damages that were not originally claimed until after I filed a small claims action.  Prior to filing the gutter scum bottom feeding attorney sent me a letter threatening to counter sue for additional damages if a claim was filed.  He did just that and it was tossed for lack of standing, he can not sue me for my mothers debts.  FURTHER, Texas landlord law is clear that where no claim is made within 30 days there is no claim forever more.  What a piece of work this guy is.  Perfect gutter scum bottom feeding attorney for a landlord that steals from the dead.

I have a similar situation. My mother also did not have anything to her name besides a car. She lived alone in an apartment complex in Virginia. I have tried Googling the law regarding security deposits when a tenant dies. She died in May.

We do have to form an estate now because my family feels there was medical negligence with the hospital. Not sure if we're past the timeline to request that deposit back or not, but I figure it's worth looking into.

How is that the lender says you can cash out refi at 70% LTV on a $120,000 house with an $11,206 balance due on the original loan, plus $1793.79 in fees equals a cash payout of $48,999.79. The math doesn't work in my simple mind.

My math says where the hell is the rest of the money.

BP family:

looking for a referral for a very skilled handyman, or a contractor and plumber.   I have a friend who became a landlord by default and has a house in Burien area.  Apparently, there was a remodel done on a 2nd floor shower and the work is deffective.  Water in now pouring into the kitchen below when the shower is used.
