Having read this entire thread, I've not seen 1 person advocate for evicting folks who have legitimate hardship.

This is about restoring a balanced approach to the problem.

What scares me a lot specially about the California no eviction law is that it states it will last 90 after the state of emergency is over. State of emergency can last years as its often left in place long after the initial problem has been resolved. 

Can any of you talking about “planning for any risk” honestly withstand years of no rent? Let’s be real, this is bad, poorly thought out policy!

Some folks here act like market forces are not a thing. Let's see, in California they made shoplifting NOT a crime. (but you still have to pay for your products). How did that work out? Massive theft like never seen before, that's how.

Now California says not paying your rent will no longer result in eviction. (but you still have to pay your rent) How do you suppose that will pan out?

Creating a bunch of new legalized crime during a pandemic is not good for society. We can do better is the point.  Let's HELP those who have hardship AND not create new problems in the process. It can be done but not if landlords don't have any property rights at all. We need some sort of balance.

@Tim Coppola I think you and I are saying the same thing. I don't disagree with the intentions of the eviction ban. I realize it's purpose.

You're also right that at some point tenants will have to pay in full. If you've been a landlord for anytime at all, then you know that will not happen. Once behind the odds of your tenants catching up or paying a balloon payment are next to nothing.

As far as my problem tenant, I am certainly being patient and killing her with kindness but she has no interest is "working with me". It's a tricky situation for sure.

@Matt Humps It is moot because this thread is NOT about risk nor one's "capability to bear risk"

I NOT once claimed I was unable to pay my mortgage. This is not about that.

The issue is that LAW should not compel me to accept theft with no recourse.  PERIOD

Can you imagine any other business being compelled to provide free goods/services with no recourse? NO

I pay taxes on my buildings, I pay my mortgage, I pay my business license etc. AND I don't want to be compelled by law to provide FREE services to those who ABLE and refuse to pay.

Those in need who have a hardship I am GLAD to help and capability is NOT and issue. But those trying to abuse the situation should not be allowed to do so because that's not good for anyone.

Those laying down and allowing government to steal their shirts scare me.

@Stephen Keighery Consider also that it may be more complicated than you are considering as well. Nobody doubts the good intentions of the law but trading one problem for another isn't helping. 

Consider the mechanics of how a tenant landlord relationship works? Why would anyone pay rent if law no longer compels them to do so?

We aren't talking about people with a REAL hardship. Those folks should be helped and most landlords would love to be flexible and partner through the dark period.

However, neutering a landlord totally with a blanket removal of all rights leaves no room for the normal mechanics to take place and invites rampant abuse. 

Why act as those policy with some balance can't be produced? Because it can and it should. The current situation is a disservice to all.

@Ian C. What you're describing is the total collapse of California. I've often thought about getting out of here, don't get me wrong but if what you're saying is true, wouldn't there be no refuge anywhere? Not to mention 1031 is tricky if lenders won't lend. As kindly as I can say it, I hope you're wrong about all of this.

@Jim K. I can do without the graphic visual. That aside, I actually agree with you. I don't think there is a single thing that ensures anyone has any "rights". It's a concept made up by people. Although, it's a concept I believe in, and would fight for. So I guess, if it means I end up in some twisted scenario as you describe, then bring it.
