Property is in Ohio.. I'm def Evicting and I'd like to just move on but they've done damage, stolen and sold items from the house..its a whole mess of things i really don't want to let them get away with. So i want to do what i can to recover what I can.. I just don't know if there is any options. i will say I learned so much about being a landlord during this tenancy .

So i have a tenant from hell that I'm finally going to be able to evict now that the city the property is in has started hearing evictions again. So this tenant gets 3 disabilities checks, 1 for himself and he gets one for each of his 2 kids. Since Covid happened they chose not to pay rent or water, knowing I couldn't do anything.. Despite them still getting same income and the 3400 for stimulus.. Just all around douchebag. i know I can't garnish the disability checks, is there anything I can do? Can i attach to a tax refund? is that difficult?

Its more to confirm suspicions and gather more evidence.. I'm not sure how thorough my evidence needs to be as Ive never had to do this.

So i posted before about that to do to make sure i followed everything to legally enforce my rights. So quick back story. Found from family that drive by and keep on place for us since we live in FL and house in ohio..They noticed 2 things, cat house in window and cats in windows...which my policy and lease state no pets. Also has tenants mother living with them that not on lease. See her alot early in morning in pajamas on porch...so assuming living there. Also have issue where theres some damage to outside...screens torn out, cut a hole in garage to put a wood burning stove(also against lease) SO last week I sent them a notice via usps(not certified, priority with tracking) scheduling inpsection today at 10am(plenty of notice) also sent copy via email yesterday and text yesterday all before 24 hours. He replied back that I can't come in and if I tried he would stop me..(like physically) so I went to city PD and got a Civil standby and had them come to house..Changed the locks on front door and padlocked garage, the side door they used coat hanger so i couldnt open from outside.. I was going to get bolt cutter and get access. Talk to police and they say the notice needed to be certified and i couldn't access...that doesn't seem right for what my lawyer said. I obviously don't want to get arrested, but i need access to house. Should i even bother or is the refusing me entry enough grounds.. After finding out about pets/occupant, i sent a notice back in january to quit and vacate. Jan 31 was deadline. I'm going back in couple weeks and want to know how to gain entry....hes claiming his disabled son is afraid and threatened by me (eye roll) again, never said a thing to son and I live in florida and haven't been at house since i gave them the keys.. Oh and a kicker, every single window in house and garage has some type of cardboard or plastic blocking the window..it looks ridiculous but they obviously want to hide something.. Any one give me some advice? I really need them gone

@Ricardo R. thanks for clarifying on my biggest concerns about entry. I plan on bringing someone (preferably a police officer as I know them well and did work for the city) but def. going to have someone come and bear witness and record. One other question about notice.. say I send them a text and say for example today being 2/14. i say I will be coming to inspect premises 2/22 at 1pm. Is that too much notice? is there such a thing?

@Jill F. I wasn't talking about now, i was meaning after these tenants are out and moving forward with new tenants under a month to month, at least initially. @Tracey Thornton Huron county, actually right next door to you, Bellevue. Right on E. Main

Thanks For the input and sage advice. I have consulted an attorney via my legal shield. But its always better to hear from people that have done it and what's been successful. I gave them the notice to cure back in january. They are unfortunately in a year lease.. seems like moving forward month to month is in best interest atleast for the first bit until I know they are good tenants. I probably just need to have a PM handle the property.. Problem is its a small town, not alot of options. Huron county. What about my question pertaining to the access during inspection. Am I able to open doors etc?

I moved from ohio to FL about 5 years ago and rented my old house out in ohio. First tenants were good no issues, second ones are a nightmare. I have a strict no pets policy, I know they have atleast 2, also have one of their mothers living with them without being approved or on lease, I also believe there is some damage that has been done. I sent them a notice to quit in beginning of Jan with the 31st to vacate, they obviously haven't. They paid Feb, paying 5 days late every month but it gets paid but want to evict on all the other issues. I also found items I left in the property for the property being sold by tenant on a facebook garage sale. Bottom line i need these tenants OUT. So my next order of business is going to be taking a trip and trying to get an inspection. So I have a couple questions. I know ohio has a reasonable notice requirement of 24 hours, so I don't have problem with that, I normally communicate with tenant via Text. Would this be an acceptable method to deliver notice? I could also post notice on door after I get in town in addition. Do i need permission after that from tenant or can I just go in and do my inspections? Does tenant have to be there? Second question is if tenant is present but has specific doors closed(bedrooms etc), can i access those area's. I believe thats where they are hiding animals. Also as far as unathorized tenant, any tips on what can constitute proof. We have someone that goes by the house daily and notices both animals in windows and the unauthorized tenant on porch smoking
