Hi Andrew, 

This is in Dupage county. 

No the paperwork has not gone to the sheriffs office since he is allowed to stay until June 30th. Thats why the judge has to sign something to give to the judge on July 12 if he is not out. 

I want this on his record as this guy will do the same crap to someone else.

 So he is only "evicted" if the sheriff kicks him out?

Hi All, 

I finally got a judgement in court to get access to my property by the end of the month from my crazy tenant.

Online in the court records the case shows up as: 

RESIDENTIAL FORCIBLE ENTRY AND DETAINER (POSSESSION AND MONEY JUDGMENT


The final entry shows up as: 

POSSESSION OF REAL ESTATE

The next hearing is set for July 12 2017. This is in case he is not out by June 30th we can request the judge sign the order to allow the sheriff to remove him.  (The case shows up as "Closed")

Does this "POSSESSION OF REAL ESTATE" mean he has been evicted? I also have a monetary judgement. 

Just curious as to know what this term means.

Sooo I have a new update for those who were following my case: 

We had a hearing for May 16th which was delayed since the tenants attorney withdrew, the judge had to allow 21 days to allow the tenant to find a new attorney. 

My attorney says he cannot pull the attorney card again. Who knows, this guy has many tricks up his sleeve. 

So now the next hearing is June 1 2017.  The nice thing is the original court order says he had to be out by end of june so should bring us closer to the end also. 

Just shocking how to see how the "law" allows for this type of stuff. 

Here is hoping that June 1 is the final hearing - unless he finds another way to delay. 

My attorney says that evictions should not be cases like this where there are constant delays, but the tenant has found a way to use an attorney to keep delaying. 

The funniest thing is the tenants attorney has not been paid either and openly said at the hearing where he withdrew that he has not been paid so the chances the landlord will be paid is probably minimal. I guess the guy who has been defending this slimeball is out of pocket and deservedly so (if it is the truth - which I highly doubt)

Oh I will for sure be filing for my losses.

Is it possible to sell the debt an agency? I know you get way less but not sure if that is possible?

OK my attorney just looked into this. 

It seems the tenants attorney with withdrawing due to the tenant not paying him (so what chance do i have of being paid lol) 

My attorney says he may ask for another 21 days to get another attorney but my attorney will argue that this shouldn't happen for various reasons and that the May 16th court date should stand. 

I just hope this judge agrees on May 11th to no longer extend this date and keep the original date and get him out for non-payment.

hi all, 

after several delayed hearings and various excuses for postponing hearings and the eviction a motion was agreed for a hearing on May 16th. (Agreed on May 3rd) 

I checked this morning on the website it seems a motion was entered to withdraw that date and and change it to May 11. 

This would probably have been done by the tenants attorney and not mine since he knew nothing of this date change. 

Is this type of stuff allowed? I had a ticket booked to fly in from out of town to testify that the tenant has not sent any checks and now they are changing the dates on us. 

Is this legal to do this?

My realtor screened him when they found him, 

Wont be using this realtor again for next time if the property doesnt sell

this is dupage county. 

That way they can ask all the questions they need to. 

Who knows if a change of lawyer is going to help much. 

It's just a bad situation and the judge is allowing the tenant to get what he wants which is to stay until June and pay no rent or utilities and let me get stuck with it.

the plan is to sell the house. I never wanted to rent in the first place. 

Apparantely he has mailed those checks out and I'm just not cashing them is the defense being used. 

I need to fly in because they they want me to do a statement each time. And each time he doesn't turn up and has an excuse. 

This is what boggles my mind that why the judge is allowing this. 

He forced he to agree on a court order on March 31 that he would pay all the missing rent and utlilities and all the other monies I'm owed for other bills by April 15. And let people in to show the home. 

He did none of those things and the judge is allowing this to continue and continue. 

I'm not sure if this judge is corrupted or what the reason is as to why he allows this to continue.
