so the hearing has been delayed. The tenant got a lawyer so the judge gave them time to review the case etc. 

Now there is a pre-trial conference and then a new date for pre trial. 

This is after my flight has been paid for to fly into IL for the original date. (I live in WA)

Can't get my money back for the flight either since they pulled this off less than 24 hours before my flight. 

What a joke.

i did ask I haven't heard back yet. But I'm sure I will at some point before the testimony. One question I was also wondering was what if the tenant tries to cure the issues from the 10 day notice? This would be well after the notice expired. Would that prevent eviction? Not all the items would be cured however since much flooring in the home was changed and rooms repainted etc. 

But he is trying to setup a payment plan to pay the unpaid bills with the water and sewer companies.

Hello All,

State: IL

My attorney has asked me for provide a testimony under oath for eviction (bench trial).

What type of questions will be asked? Not sure if anyone know?

I was told the following: 

"I will need either you or a qualified agent to show up to court

and I will ask you questions under oath - this will be your testimony

for the trial."

I have no more information on this right now

What is the best way to check his renting history and perhaps other nonsensical lawsuits he has started in the past? 

i know this guy has a habit of doing this. when i googled his name - the first thing that came up was dirtbag alert - he has conned people in the past and tried to sue for things such as defamation etc. 

I was an idiot to rent to this person.... never will i make this mistake again

I googled his name AFTER he was in. Not before. I'll not be using this realtor again who found this guy,

This is a case of this tenant wanting to buy my property for next to nothing and is using as much as he can to manipulate us. 

I will wait to be served papers for any of his threats of lawsuits. 

Hi All, 

State: IL 

My tenant is finally due in Court this Wednesday for the first Eviction date. Since he has been served the summons we have received multiple text messages from him that he is starting an "in-depth" lawsuit against. 

I am not sure of the exact details of this lawsuit just yet. But it could be things such as: 

1. He had a 2 year lease which ends July 31st 2017. He wanted 4 years lease but we turned this down. He wanted to purchase after 4 years but we told him we are not looking to lease for this long and only agreed to a 2 year lease. 

2. He has been misusing our pool (indoor) and he cause mold - we had the issue fixed 2 times and sealed to prevent problems - I think he is going to try to claim health issues also. 

The fact is I have given him many opportunities to leave and release him from the lease for health reason (since Jan 2016) But he has not, 


All in all I think he is trying to manipulate us into selling our home to him for next to nothing (I have an email from his realtor - as late as Jan 28 1017 -  listing ridiculous issues with the home and how an agreement cannot be reached unless we significantly reduce the price) 

We have no purchase agreement and no 4 year lease agreement and we have been telling him that we intend on selling once his lease is up since the beginning of his current lease. We have the paper work for the work done on the mold also (that he caused - I have a feeling it was done on purpose by NOT using the de-humidification system) 

He is being evicted for multiple lease violations (Not paying water bill (over $1000) or the sewer bill (over $400) and making changes without written consent and finally not paying 50% rent - he told us over the phone he would not pay until we agreed to extend his lease) 

My question is: Will judges see through this frivolous lawsuit? I see this as a bully and retaliation tactic since he is not getting his way and now that he has been served court summons he is going to try to list as much as he can in this lawsuit. 

He has threatened my wife over the phone that he will try to get every penny he has paid us in rent since Aug 2015

I will get an attorney on the case of this lawsuit but wondering if anyone has experience with this type of lawsuit after eviction is filed.

I want him gone and do not want to accept the rent. 

My question is: 

Should I let the tenant know that I am not longer accepting rent? 

Or let him try the deposit and let it come back to him since the bank account is already closed?

Hi All,

Quick question, I spoke to my attorney this morning in regards to a tenant where has been given 10 day notice for various different breaches - one breach is paying only partial rent for this month. I want to evict due to the number of issues with this tenant. The tenant texted me on Saturday saying he will pay the remainder tomorrow.

The attorney says that not to accept this - which is fine I do not want to delay eviction so it is best not to accept it.

My question is should I let me know tenant know that I closed my bank account where he does direct deposits to? (I closed it so to no longer accept partial payments) and that he should mail me a check to the new PO box I opened? (I do not plan on cashing it)

Or should I tell him outright I am not accepting any more payments? (I prefer not to do this - as I do not want him damaging my property on purpose)

I forgot to ask that of my attorney but I thought Id ask anyone else their opinions.

Eviction will be filed this Friday coming since the 10 days will be up.
