Just got the new list of properties for the upcoming tax foreclosure auction. My state has an absolute auction that provides lien-free title to the property (with the exception of Federal liens). I'm wondering how I should market to these. Do I mention the pending tax auction? Or just market with the standard "Cash for your house"? I obviously need to play up to the urgency as the auction is in two weeks.

FYI...KCIG is shut down for restructuring right now. They're looking to be back up and functioning again by late spring/early summer. There is a fantastic informal meetup the first Saturday of every month, though, that's put on by a couple of members (both of KCIG and MAREI). It's held the first Saturday of the month at 10am at the Panera Bread off Metcalf and Johnson Drive in Overland Park.

Mid-America Real Estate Investors Association (MAREI) is probably the biggest. They meet the second Tuesday of the month.

I typically send postcards but have used an online people search service to obtain phone numbers.

I've had good luck with bandit signs. I also get the legal record newspapers to check for probates and pre-foreclosures.

It doesn't have so much to do with Kansas being a non-disclosure state as it does that Kansas has a "unique" privacy law in place that prohibits the use of information gained from public records to use for sales solicitations. Because of this law the list-brokers don't provide lists at all for Kansas because they don't know what the customer is going to use the list for and they don't want to get busted for violating that law.

What I've had to do is to pull that information myself from county records. Usually the county tax records. For instance if you go to the Sedgwick County tax lookup page and put in the address you can click the Property Detail button and it takes you to a page that gives you the property owner's name and the mailing address of record. It's very time consuming but it's about the only way to do it in Kansas.

In both cases it was about helping people with problems AND getting a good deal for a rehabber by being honest and up-front with all parties. When I talk with a seller I let them know that I will be finding someone who will do the actual rehab...when talking with buyers I let them know right away that I'm wholesaling the property. As far as the legal issues go, it varies greatly from state to state. Typically if you present the deal as a contract for sale and not a property for sale then you are safe. It also helps if you do what's often referred to as "reverse wholesaling" where you get your cash buyers lined up along with what they're looking for then when you get a property under contract you know exactly who to call to offload it without having to really do any marketing at all (which is where regulators tend to bust wholesalers.)
