Hey BP community,

I’m working on a “subject to” purchase in California and I’m looking for a real estate attorney who can draft all the required documents for a clean and compliant close.

Specifically, I need help with:

  • California-compliant Purchase & Sale Agreement tailored to a subject-to deal

  • All necessary disclosures to protect both parties

  • A subject-to addendum with language around existing financing

  • Any other legal docs or advisories recommended for this kind of transaction in CA

Bonus if the attorney is also familiar with:

  • Using a land trust and LLC as part of the structure

  • FHA/VA loan scenarios

  • Strategies to reduce exposure around the “due-on-sale” clause

OK- so haven't stopped searching the web for more insight into what NR is really about. For every good thing I find - there is 3-5 bad reports about them.

So Amy you wanted to hear more.. Ok, let me say this again **I AM NOT TRYING TO BASH ANYONE*** I want to make sure of what I'm hearing is the truth and not a way to put my $16,000 in someone's pockets. But after all that I'm seeing in the negative, it doesn't look good. On the web I see so many people warning about NR, I won't get into specifics of what I've seen but there are several references to the founder(s) of NR getting into some real legal trouble. With that said I will give you my OPINION pertaining to MY experience so far with NR....

I mentioned the way they dressed... every successful or aspiring to be successful RE agent or Investor I have ever met, projects their successful image well with what they are wearing ie,.. fitted suits, tastefullly coordinated. These guys were wearing what looked like "thrown together" outdated suits from the Salvation Army store or the local 5 and dime shop. I mean they both claimed to be making a minimum of $30,000+ a month, if you were making that and wanted people to follow the program that you are trying to "sell" then wouldn't you take the time to look like you make that much?!?!!? My point is they looked like salesmen (kinda like the encyclopedia guys from 20 years ago)..

Next when I pressed them for examples of what / how / when / they were able to sell-or-buy RE, they gave me VAGUE answers. I asked the main speaker how much had he sold last month- answered by telling me he had found a property on the "concierge" and was able to turn it around "in record" time and very quickly went itno "YOU SHOULD COME TO ANOTHER BIG SEMINAR IN TWO WEEKS TO GET MORE INFO".. He never did answer me directly. They kept "picking" people at random from the group, ok I gotta paint this picture for you - the people who answered the ad to work in real estate (like me) were wearing one of those sticky name tags you buy for $5 at Staples, the "PROFESSIONALs" were wearing Nouveau Riche gold name tags. The presenter would "randomly" pick people from the group to gve input to the presenters questions..ex- "now you wouldn't just leave your money sitting around, you would want to invest it into more real estate wouldn't you David"?, David was sitting behind me and he answered yes (go figure!) More about David in a minute. There was also 2 older ladies that were in our group that he kept coming back to asking for input to his other questions. I knew the guy sitting next to me was attending the seminar for the second time as well as David. now this is were I started getting the creepies, they kept giving each oter looks while talking to me.. maybe nothing at all. When the main presenter asked everyone to introduce themselves to one another I turned around to David and talked more about RE. He kinda gave me some back ground on himself and that he had been to "several" NR seminars. I asked why he would go to more than one of these and he said to get more info (since this was the intro seminar and was his multiple time being there)( I mean how much info do you get from the intro anyway?), also he had already attended one of the "colleges" and was looking forward to the next one dealing with "short sales", and that he wanted to just be an investor not become a licensed pro of any sort.. The presenter asked some silly question I blurted out OOPS! as the answer, he retuned to a few more times I felt the whole "questioning" was normal. now towards the end of the seminar I realized that there was a difference between the way I interacted with his presentation and the way others had interacted with him. The difference was subtle but with me it was a "punch line" to be used as a joke (which I'm not complaining about, cause that's how I meant it), then the others he seemed like he was getting them to reinforce his ideas and beliefs. Maybe I read too much into this whole thing but that's how I feel about the whole seminar. I don't plan to go to another one or to join their organization in any way.

Ok - about me, I'm like most people who want to get everything and not lift a finger, but I differ cause I know in this world you HAVE TO work! 13 years ago I was one of those guys cruising around the malls and parking lots trying to sell stereo speakers to people, I did pretty good at it, stuck with it for about 5 months. I also used to go door to door selling Magazines, newspapers, Perfume, "executive writing" sets, cookware, and I used to telemarket time shares.. I learned there is NO EASY WAY to make money. The fantastic stories these "presenters" were trying to feed the group I was in, sounded like me a bunch of years ago trying to make the next sale to win the cookware set. I get a feeling that when something sounds "canned" I feel nauseous, that;s how I felt in that seminar.

Like I keep saying - I'M NOT TRYING TO BASH ANYONE, but I will not hesitate to share my opinion, I don't think NR is right for me, sounds looks, and feels like a "DISGUISED" MLM, and a second rate "No Dollar Down" scheme. Maybe if you go you will have a COMPLETELY different outlook on the company and will actually get into it and BE SUCCESSFUL, if you do go for it - I hope you are successful!! I'll stick with getting my license and learning the ropes that way, may take longer but it's tried and true, with some hard work maybe I;ll get a break and make some really good money at the same time. OR_ maybe I'll figure out a way to GIVE myself a break and make money at the same time. Right now I'm a pc network techician, this time next year I WILL be an RE agent and Investor.

OH- David---- I just found aother RE website/service where David is listed as REAL ESTATE TRAINER with NOUVEA RICHE!>>go figure!!!

hmm....

I thought i'd chime in..

I've been trying to research more about N.R. .. I just went to the "intro seminar" (ealier tonight, about four hours before this post), I found I knew more about RE (&) I, than the 2 "instructors" ( who claim to be making 30,000+ per month..

1- looking at these guys I assessed them from a visual point.(how did they look), they were both wearing CHEAP "dress for less" suits, the main "presenter" had worn out PAYLESS "real-immitation-fake-leather" shoes. The other one was wearing Hirachi sandals that looked like they came from PAYLESS.

2a- neither of them could keep their stories straight- the first one was from Utah-28-with a baby girl, 2yrold-his first child (and implying it was his and wifey's only so far by saying they wanted more soon and now they can afford it). 30 minutes later he mentioned his 5yr old boy! -----HMMMM?!?!?
2b- The other guy was a former investor from Marshall Reddick' course, only he couldn't tell me how many properties he had owned or sold, his answer was - "i don't remember, but it was up there and I did make some money from it" .. I asked him point blank because the other guy intro'ed him as a "VETERAN R-E-I"... then about 5 minutes later he suddenly remembered the "5 or so" properties he had owned but "flipped" for quick profit.

Hey let me make myself clear- I am not trying to BASH anyone! I hope this is just me being very picky and SKEPTICAL, but i'm finding it hard with so many bad reviews on the internet. I would love to be able to say this is what i am gonna do - but it doesn't look so good right now.. ps-i am studying for my CA RE license, so i do know a tiny bit.

I want to write SOOOOOOOOOO much more about this seminar/sales pitch.. but I just had a minor outpatient surgery done to my right index finger and it's a BEAR to type.. I'll post more or you can PM me and we'll talk..[/u]
