@Henry T. Only problem with doing that would likely result in my insurance company dropping me and then I'm in the market for a new insurance carrier which I'm trying to avoid.

As expected I received a rebuttal from the applicant, after explaining to them our insurance will not allow aggressive breeds on the property. See below

Thank you for reaching out - is your insurance aware that their refusal could violate the FHA? We really loved the property and we’d be remiss if we didn’t at least try to find another way to make this work. The specific section regarding this scenario is cited below. I’ve read that it can be applicable to both tenants and landlords as it may impose undue restrictions and discourage renting to persons with a disability.
I’d really appreciate it if you could run this by them and see if they change their mind or make an exception

“A prohibited activity under the FHA, 24 C.F.R. §100.70(d)(4), is to refuse to provide property or hazard insurance for dwellings or to provide insurance differently because of handicap.”

@Denise Supplee I specifically asked my insurance company if the applicants carry thier owner renters insurance with a policy that covers the dog would they allow it as an ESA. They said, that I as owner of the property would still be held liable in the event something were to happen. It's a risk no matter which way you look at it. I would still have to report it to my insurance company and they ultimately could drop me.

That's what I was afraid of. Unfortunately, they meet all of our qualifications otherwise so there is nothing else we could deny them on. 

I did get a response back from my insurance broker below. 

"This is for any policy with (Insurance provider). You cannot have a dog of those breeds in any Homeowner, Rental or Condo policy insured with (Insurance provider). Unfortunately, this is breed specific, not training specific so the amount of training applied to the dog for Servicing won’t matter."

Met with a couple and they were perfect candidates; met all of our criteria. At the showing they informed me thier ESA is a pitbull. I made a call to my insurance broker yesterday and they of course they said "no aggressive breeds". I asked them about the ESA status the dog had and they said, doesn't matter, that I could still be held liable. 

After reading through HUD information, I am understanding that our insurance denying us because of the dog breed would fall under the following:

  • "Granting the request would impose an undue financial and administrative burden on the housing provider"

I have read through some other forums, just wanted to get any additional feedback from others and how they dealt with this situation.

We switched our 2 rental properties over to an LLC. Can we do an addendum to the already existing leases stating the new ownership and have them sign. Or should we have them re-sign the whole contract under the LLC?

We have 2 investment properties in North Ft. Worth that have worked well for us. One was an investment property that we BRRRR'd and the other we lived in as our first home. Both have worked out great for us and we are now looking to find our next deal. I would love to make some connections in the area and talk with other investors that have had success.

@Michael Plante In asking for help I meant advice on how to respond to this situation. They have not said they want to break the lease, I think they just wanted to see if we had similar occurrences happen to us. For now I guess I will just wait to see if they ask to break the lease and then go from there with the motions.

@Joe Splitrock I guess I wanted to offer some kind of remedy. I left it at that, but did not mention anything to them about breaking their lease.
