Happy new year everyone. 

Is it easy enough to terminate a month to month lease in 1 of the units in 3 family house that is not owner occupied?
Location : Weehawken, NJ. 

Issues: has been difficult with this tenant forever. tenant is not paying increased rent from the last 2 months even after increased rent letter sent by normal and signed mail, is ignoring texts & phone calls apart from other issues like having pet in non pet unit, parking bike in side alley etc.  

If so, can I do it on my own or need a lawyer for it?
Do I need to provide all the reasons in the letter?

In an Investment property in NJ, landlord cannot take a tenant out without a valid reason even if a tenant is on a month to month lease. That's what I know from my brief experience being a landlord. I just want to be precautious before giving him the notice. 

Any other ideas I can implement before sending him the notice to vacate?

I am still thinking i might need to prove somehow that he has a dog.

Goodevening from NJ, 

I have a tenant in my 3 family Investment property/house that just got a dog without informing or asking me and has a no pet allowed written clearly in the lease. I came to know of it when my next door neighbor told me about it since I do not live there anymore. 

This tenant has been there for a little more than 2 years and has been a constant problem. He is on a month to month lease now since I did not renew the yearly lease. There are more people living in the apt than mentioned on the lease. He has tried to install cameras on his own in the front of house recently without my permission. He has also tried to escort money from me in the recent past citing some issues in the apt. etc. My Relationship with this tenant isn't good either.   

I do have allowed another tenant to have dogs in another apartment in the same house and has it written in his lease already. 

How can I deal with this situation, I do not mind loosing this tenant?  

How can I prove that he has a dog before taking any action?

I'd just send her a check for your best estimation of the actual cost to her and a mathematical explanation of how you got there. [(Bulb wattage) X (3) X (Hours on per day) X (number of total days in her lease) / (1000)] X (the kw cost of electricity) In your letter, explain it is the past and future considerations for the hallway lights being fed from behind her electrical meter during the lease period and will be the only consideration made.

I would approach this situation in a calm and respectful manner. Let the tenant know how you got to your number ($9 / year / lightbulb). If your tenant is demanding $70 / month, I would ask how he / she is getting to that number. As long as you are respectful and understanding, everything should work out!

Hi, 

My tenant just discovered that three different ceiling lights with led bulbs in hallway are on her electricity. I do not have anything in lease that says anything exactly on who pays for the hallway lights. She is asking me to pay her for all the past months she has had lease with me. 

I checked online and it seems like Led bulbs have a consumption of $9 per year. With 3 bulbs in total, it will be 27$ per year. But she is demanding 70$ per month and not budging. What do you guys think I should do - pay her the entire amount or ..

Question 2, you could try and sue but id take it out of the security deposit and move on. Unless you're out much more? If they bought their own place they probably won't care about a bad landlord reference or an eviction notice. Obviously that could be a lie they told you. Depending on the damages minus the SD, that would tell me if it's worth pursuing or not. 

Thanks for the reply. But due to Covid they still owe me last 2 months rent. Even after security deposit, I am still looking at  6k due between rent and repairs. -- Mike.

A month to Month Tenant vacated my apartment during the middle of the month by giving notice few minutes after vacating the apartment. History : Initial Yearly Lease was converted to Month to Month Lease after Tenant's request after 5 months of occupancy since he wanted to buy his own property. Tenant stopped paying rent thereafter, sent eviction notice, started paying rent thereafter. Total Duration of occupancy: 1 year 1 month(all this happened within 1 year 1 month of occupancy).  

Location: Hudson County, NJ. 

1. The notice period for a month to month Tenant can be given in the middle of the month? 

2. Do I need to get repairs done or I can sue him on the basis of quotes for repairs?
