I was to propose they see if they have a place but i wouldn’t know why her would take her on and continue to deal with her. They’re the ones that placed her in the first place

I currently have an issue with a tenant that I have been trying to remove since May (that's when their lease was over). Due to the moratoriums, they are currently month-to-month. My PM sent the 30 day notice on June 30th. Today, I was made aware that she was unsuccessful finding a new place due to her credit score. She stated that she filled out several application with no luck. She said there is a apartment complex that may take her because they do not make their decision based on credit score alone. She's not a good tenant. She doesn't care about the property nor does she care about maintaining it. I've tried to maintain some of the maintenance out of my own pocket. I do plan on taking that portion from her deposit. My PM told her that if she does not find a place by end of July that we will start the eviction process. This worried her a lot as it should have. She texted me and told me that she needs to stay until end of August in hopes that this new complex will take her. She said she is willing to pay extra to stay. My issue is this: I need my place back so I can clean it up and make it look presentable for the appraiser because I want to cash out refi. This was my goal at the beginning of Spring. If no one is willing to take her now, I do not see that changing in the next month. I do want to start the eviction process and have her out by end of August for sure (contingent on her not finding a new place by the end of this month). If they do not accept her and I start the eviction process, I'm worried she'll trash my place even more. So do I have her stay another month, pay the increase, and help her find a place (we have gave her some options already) or do I start the eviction process and hope that the damages are reversible? What's the best strategy or approach? My PM suggests that she stays and pays without evicting her because evicting isn't free. I just do not see that as a viable option. How do I get my property back under my possession?

So she was given a chance by current landlord to purchase property but she couldn’t get approved by lender even while having a co signer. So that’s when I told them if it doesn’t workout then I can try to buy and have her stay in the property. The lease terms states that she’s a tenant now and must abide by those agreement. No where in the lease does it indicate that you’re here because I was able to by this property because of you nor agreement made prior. I see what you’re saying though…I hope it doesn’t come down to this. We will see how things play out. With any real estate transaction things can go south quick. I have a good gut feeling about this tenant and the sellers.

It is too late for that but definitely appreciate the knowledge and will use for next closing.

I’m talking to landlord, he mentioned that she’s been there for four years and she’s paid every month, even during COVID. It didn’t make sense foe me to have her occupy one of my properties then find a new tenant for the new property. I did not like the bankruptcy issue but I’m willing to take it on and we will see how things shape out. I will be conducted a final walk through. Her current lease was terminated and her original deposit given back to her. She was informed of the rent increase and she did sign my lease and agreed to all terms and conditions. No different than any other tenant process that I go through after I select them. Again, she was very thankful she was able to stay because her kids ready loved that school district and would have been hard for her to find a new place because of that recent bankruptcy.

We terminated old lease and they signed my lease effective date of closing. I did not get rental payment history which i prob should have. Also, I did a walk through about a month ago when I went to look at house to see if I was interested. It looked to be in great shape. The problems I was concerned about I had the inspector take a closer look at it and he gave the thumbs up. I like the area and the tenants have been there for four years because her kids love the school they attend. I feel confident that I inherited a paying tenant.

Very smart. That idea crossed my mind. I didn’t ask for it as I took the landlords word for it. Regardless, I would have to keep the tenant as it was part of the deal…sort of. Now if tenant doesn’t abide by lease terms then i can evict.

Hello Everyone,

I am due to close on a property that has an existing tenant. Long story short, I found this property off market. The current landlord was to sell this property and would have needed to evict the tenant. The way i found out about this property was through one of my existing properties that I had listed for rent just a few blocks away. The current tenant visited my property and asked if I could lease it to her. I told her that I couldn't due to her not so great credit score because of a recent bankruptcy. Bankruptcy was due to medical bills. I told her that I could purchase the property off market if her landlord agreed to it and I would keep her as a tenant. She gave me her landlords number and he was interested selling off market. I own other properties but never bought with an existing tenant. Anything I need to know in terms of how to proceed once I close? Anything important I need to ask or find out? The current landlord and his wife (who was the agent in this transaction) were extremely nice and very helpful. I trust them and i do strongly believe that I did not inherent a bad property or bad tenants. Having said that, I still want to do my due diligence by getting some advise.
