I have dealt with my fair share of this. My approach has always been to encourage the tenant, congratulate them on their new home purchase and inform them of what they need to do to be released from their obligation. It is best to get these terms in writing and signed by both parties.

  2. I would start marketing it immediately and set up showings with pre-qualified prospects Nov.1 .   3. They need to give permission to show the property once vacant. 
  4.  They will be responsible for paying the rent and utilities until it is re-leased. If they need to terminate utility accounts, in order to establish at the new property, they will be billed back each month for the additional utility expenses. 
  5. They will be responsible for a $350 marketing fee UNLESS they find a qualified tenant, who signs a lease. I've had tenants market the unit on FB and at work. 

If they BAULK at that, just give them a friendly reminder that they have signed a lease and could be on the hook for the balance of the term and early termination fees. In my experience, they have seen the deal as more than fair and were happy to cooperate. GOOD LUCK. If you have any quesitons, don't hesitate to ask. 

Hi. So basically you only charge them $350 as the advertisement fee and not for any loss.   Could you tell me if you report this as part of rental income for tax purposes?  

Good point about the utilities.  I do not want to switch to my name or have it turned off.    My other question is that they put a direct tv dish which is huge.  I asked the installer and they told me they don't uninstall it.    Should I keep it with the house ( as direct tv ready,  although this is moot because they install for free with new sign up ) or make them pay direct tv to remove it no matter what?

I have a tenant who says they are buying a house and must break the 1 year lease and want to move out November 1.  (so it's not even 30 day notice! 12 days away?)

They have just been here the 4th month.   

What do you charge as a settlement?   (Personally the tenant is an acquaintance of mine so $0 is an option, but in normal circumstances how do you figure it out?)   The lease is CA realtor form and it doesn't say what might be the penalty as far as I recall.

 is it ethical to start showing potential new tenants while they are there?

I happen to be familiar with similar income and expense ratio.  I can tell you there is only around $500 left after rent for EVERYTHING ELSE.   Which is not enough to live in anywhere let alone SF.

I believe the plaintiff need to proof it is negligence of the landlord that caused them to get hurt.    User error is likely not the landlords fault, or the manufacturer's fault.

"More often than not, lawn mower injuries are caused by improper use or user error rather than a product defect. While you may sue the manufacturer, evidence of your own negligence in handling the lawn mower could reduce your recovery or prevent you from recovering any money at all."

problem with umbrella is insurance company, told me over 2 million need to be approved.   Otherwise one million is $x per year and two million is $x * 2   premium goes about linearly.   

2 million might not do too much with bodily injuries if you look at itemized hospital charges paying out of pocket.

What do you think the tenant can sue you for, them slipping on the grass or..  I was not sure if your question is rhetorical or really happened.

it is not exactly rocket science but, do check that everything works and I'd just ask him to please discuss with you before doing future projects.   And that he is not trying to hold your liable for any of the cost.

Hi, I was wondering if the condos are easier to maintain for the landlord.

Condos are always lower priced, but the HOA is almost like $380-$450 around me.

Let's say I am to shop with 20% downpayment which is pretty much requirement for a investment property mortgages, but no more than that.   So condos really caught my attention.   Landscaping is usually included or not applicable which had been a problem for my tenant relationship in the past.

Bank of America lets you send money if given account number, but also lets you setup a phone number or e-mail address, that way the sender only have to know the phone number or email, and the receiver will get an additional step of text or email message to accept payment.   That way you must accept the payment and have a chance to reject partial payments, which I think most here is seen as a good feature.

Is it acceptable to have mortgage paid via a separate account from another source of income?  No one says you have to pay the mortgage on the property with rent money.  At tax time you know from the tax slip how much interest was paid exactly so accounting is not too challenging.

Or is it just better to use the rent money to pay the mortgage so it shows net income?  (that's only if rent generate positive cash flow)

I was wondering if anyone have used the same bank transfer function, for example BoA.   You can transfer money to another customer if you give the account number or you can setup a phone number that links to your account number. (in fact can send across different bank also)   I was just wondering if that is a better alternative to paying by check.   It's not as strong of a paper trail but it should all show up as account statements.
