If you have it in writing e.g. tenant sent an email to the seller asking them to fix it then that would carry more weight.

The sellers are only obligated to disclose issues that they know about. If you can prove that they knew about it then you have a shot but weigh the cost of litigation vs fixing the issue yourself to see if it is worth the effort.

@Joe Crupi Majority of my clients are buying around that area. A quick example, one of my clients bought a new construction in that area maybe 6 weeks ago and the house has not started building yet and the price for that plan has already gone up by $10K. I was talking to one of the builders there and they were supposed to sell out (120-180 homes) in 5 years, it is year 2 and they have 3 lots left :|

You should always consult an attorney if you are unsure about a legal term but yes i do see this commonly in Austin sales contract

Michael Hsu (Architect) did our condo complex and it is very modern, clean and energy efficient design (5 star LEED rating). Looks like you have most of the areas covered, one thing I would say is that my client was looking at a similar deal but the land was lease hold so if you can get free hold it would be ideal. If it is lease hold than make sure you have caps in place.

IMHO I don't think a state income tax bill will pass in Texas.

I'm keeping my fingers crossed that it doesn't pass. Sounds like a last ditch effort to shove in the maximum increase before the new law caps it at a lower rate for increases. If City needs more money STR owners are happy to pay via occupancy taxes if they make the process easier to get a license.
