Hello,

1. If the proceeds of a sale are placed into a syndication, is there a time limit that it needs to stay invested in the syndication?

2.Can the proceeds of a sale be divided among several syndications (or properties)?

Hello, 

A water pipe broke and caused flooding.  Tenants will be out of apartment for 2-3 weeks.  Tenants have put a stop payment on check and said they will prorate for when it is complete.  

Will landlord policy insurance typically reimburse us for this?

Old houses with plaster and lathe can be quitter than new ones with drywall.  Check that the plaster is tight on the ceiling.  If it's not it can come down on someone.

Are there any alternatives to the 1031 exchange to avoid capital gains?  The market is still priced higher than I am interested in buying into.

Why asssume it? Why not just take it Subject To?

Good question.  I think the seller will be reluctant.  Any idea how I can convince them it's a legit transaction?

They have to be willing and motivated. If you explain that you will take over their debt and make the payments and that can be done through an escrow servicer that makes sure it gets paid, that is about the best you can do. They will have questions that you will need to answer. You can check out this post to see some of the objections they may have.

I am considering "subject to", but want to have a good contract.  Can anybody recommmend how I can find one and how I can find an attorney that is familiar with them?

My understanding is that there are some important considerations to prevent the loan from being called due.  I also need to make sure the seller is comfortable with the deal.
