Hi Trevor Smith. I agree with Andy Mallos and Jerry Kisasonak. You should focus on getting your rental above water first by either refinancing or possibly selling it. I tried to refinance my investment property two months ago but was denied due to a technicality of my main residence and the contract that I was under with my landlord. The banks that I was trying to refi with said that I had a high debt-to-income ratio, thus denied my application. This wasn't true has I have a roommate to pay half of my rent. However, it seems that mortgage companies (big or small) are very conservative with lending these days. So.. long story short, if you want to pursue further, get all your ducks lined up. Start with the rental that's in the red and work from there. In RE investment, you always want to get in with positive cashflow.

Bruce Michaud As long as it's in the contract and they are consistent with the payments on the 20th, then there's really nothing to worry about. My management was terrible. I had to ask over a span of several years to try to get receipts for things that I had paid for.

Hi. As some people on BP may know, I'm in the mist of trying to reach my property manager for maintenance/repair receipts for the past couple of years. The total is roughly $9,800 and he has not sent me one single invoice/receipt for the repairs he supposedly did. I am in the middle of filing a complaint with Texas Real Estate Commission. I don't know how much that will help me other than inform others and document a complaint.

I guess what I need now is to find a RE lawyer in Austin who can advise me on what my rights are as a landlord and what I can do to proceed from this point? Can anyone direct me to someone in Austin that I can talk about this? Thanks!

Hey everyone! Thanks for all the advice and feedback. The one I'm leaving is Iles Real Estate. It's operated by John Iles who's a broker and I've been with him since 2009. I've been meaning to find a new one for the past two years but I didn't because I didn't know who else to switch over to.

I'm in the middle of a transitioning away from my current property manager in Austin, TX. I have already choosen a new management company.

My reasons for the change are that the old management company did not send me receipts for unit fixtures and did not advise me of the renewal leases and at what rent they were going for. I always had to reach out to him to find out. I have been trying to reach him to forward the current lease contracts with the tenants but he is MIA. He dropped the ball on a couple of things that I needed as well. The list goes on but I'll leave it at that.

Being an out-of-state landlord, I need advice on how and where I can go to get help and file a complaint on the property manager and possible legal services as the property manager has advanced his service fees for the next five months . And without telling me, he has terminated his services (3/28) to me prior to our agreed date of (4/15) and yet, still deducted advance services for 5 months?! What are my legal rights?
