Dear Mr and Mrs Miller,

It has come to my attention that the outdoor areas have become overwhelmingly cluttered with your personal property. My first concern is safety. The stairs, mid landing and upper deck must have a completely clear pathway consistent with the width of the stairs. This gives anyone coming or going ample room to walk with no obstructions possibly causing slip, trips or falls. Also anything that is not secure can not be placed somewhere where it can fall and hit someone or something causing injury/damage. This is to reference all items on the railings of the deck and landing. This is non negotiable and must be remedied within 24 hours.

Besides safety, the maintenance and life of the deck and stairs are compromised because of items sitting on the wood not letting it dry properly and restricting the ability to clean and maintain it.

There shall be no use of grills on the wooden deck because it can cause a fire hazard and can damage the wood with grease or ash.

As stated in the signed lease under section 41 you are not to have excessive possessions outside the unit. We had a verbal agreement of use of the lower patio for gatherings not for placement of personal property. I'm inclined to restrict the amount of chairs to be left out at 2 chairs. Storage and placement of personal property on the premises needs to be drastically reduced. One cooking apparatus can also be used and stored on the lower patio if desired.

All other personal property must be removed from the lower area so the area can be maintained properly and used by everyone. The upper deck must be kept clean and organized and the amount of personal property kept to a minimum again for safety and maintenance. This must be resolved within 72 hours

If the issues are not resolved your items will be removed and put to the curb for disposal, and you will be charged an hourly rate of $30 for services rendered and any other charges for disposal of the items. The money will be taken from your security deposit and you will be required to replenish the security deposit to the full amount.

@Theresa Harris Thanks, yeah I talked to the husband about clearing the stairs off. He said okay but that was 3 days ago. Break in with ladder is not a concern they aren't tall enough. Fire risk,  liability, maintenance  are all issues. I'm wondering what actual rights do I have to remedy it, if they push back on fixing it, or don't do it in a timely manner.

I have a 2 family house, I live on 1st floor and have tenants on 2nd floor. They have a lot of stuff borderline hoarders. It started small but they keep accumulating more stuff on their porch, their stairs and the patio below them. I did not set a good president from the beginning, but I also thought they would be cleaner and take care of their stuff and my property better. I know the stairs are a liability that needs to be addressed immediately. What are my options? Can I tell them that they can't have all the stuff on the porch? The porch is theirs exclusively. How about the patio(common area)? With all the chairs (that never get used), ladders, flower pots, pressure washer, and much more, the area is not useable for anyone and maintenance of the area is so much more laborious having to move their stuff. (They never clean the area). Any help is appreciated.

@Dalyn Hazell Good luck with the D4D! I also think you should market to the distressed owner occupied for a couple reasons, the data might be wrong on Deal Machine, they might have other distress points too if they are letting their house go, you never know what someone is going through at the moment.  Even with low equity houses there can be other ways too acquire or assign the property, like sandwich lease options or subject to/wrap mortgage. Im trying to get in front of more sellers and just try to find their pain points and see if I can assist, even if it is to refer them to a real estate agent or the mortgage broker we use for refinancing. I think offering help anyway we can will pay off in the end.

Are there any real estate attorneys in southern CT that are proficient in creating trusts for holding title to properties? Also are there any that are knowledgeable in sub to and wrap deals. Im also looking for wholesaling paperwork like the addendum for power of attorney, an assignable purchase and sale agreement. Please send me any referrals you have or any help you could send me. TIA
