My understanding is that a law was passed in Austin back in 2005 against using Land Contracts and that this law also affected how we use Lease Purchasing and other transactions. I have not followed it lately to see if any updates or changes in Austin. You might check with www.TexasLegalDocs.com.

I wonder about a Mortgage Assignment but the $32,000 is really, in most cases, to large for that also. You sure would have to have a motivated person to take over this property.

Do you have an LLC established? Are you the sole person involved in the LLC? Of course you have to work with a CPA and perhaps an attorney to get your questions answered. We can't give you legal advise here you know. My suggestion is find a CPA that, hopefully, is also a RE investor.

I am from New Braunfels but also spend a lot of time just north of Dallas in Frisco. I have been part-time in RE investing for a number of years. Always looking for a good deal to wholesale or retail. Trained in the Inverse Purchase and have two partners I team up with for short sales. Learning and studying about lease purchases right now. Available as a consultant for farm and ranch related RE deals and I am also involved in other marketing not RE related.
