Also consider filing a complaint with the SEC on their website. It's pretty painless and could prompt action if they haven't already started an investigation:

 Avoid Wavemark Capital. They are in default on my investment and that of several other investors I'm aware of, and probably many more. Yet they are still actively soliciting investments in the fund. Disgusting.

TL:DR Avoid dealing with Mike Ayala at all costs.

Four Peaks Partners is run by Mike Ayala. He also runs the Wavemark Income Fund, a debt fund, which has been in default on an investment I made in the fund for a year and half. They failed to return my capital after a year as the contract stipulated and they stopped making interest payments entirely almost a year ago. I've learned of several other LPs in the same boat through the Kelley Clarke Law firm that is representing several of us and through the Reddit forum linked below.

A principle at the firm suspects they are under investigation by the SEC. 

And yet they are still soliciting investments in the fund! Stay away.

I'm aggregating a list of investors he's defrauded to share information and coordinate possible action. Please contact me if you're among them.
