Lots of people fall on hard times and if this person truly has family and friends around close they can help her through this! Your a business not a charity! Stick to you eviction terms and follow through! I agree to offer cash for keys but make sure everything is out first! You can do this and remember you did your best all through the lease terms! Time to be tough and move forward! You may need to consult local eviction attorney but I bet cash for keys will motivate! Good luck and hang in there!

Thank You... so the issue comes in with the primary residence.

If she moves forward with the other property as an investment then no issue with the usual 20% down.

Howdy BiggerPockets community. I"m in Southern California and I have a client who purchased her home in Oct 2016.  She has done massive and impressive renovations and now rents part of it on Air Bnb for a nice profit. There is now another property in her community that she has her eye on because she knows it is a good money maker and she is in the prime location for managing it as an Air Bnb.

Her current lender is Eagle Home and they say that she has to wait at least a year before doing anything new. I know from reading BiggerPockets that isn't necessarily the case. So I'm reaching out for recommendations AND advice!

She would like to 1. refinance and pull cash out from the new appraisal 2. buy the new condo as primary home for lower interest rate and move into it to start the improvements.

There were no attorney's fees. It was a general consult with court house legal information officer. I issued the eviction because it is my property and I have a lease for the property for my tenant. She was allowed per my lease addendum to extend invitation to her boyfriend. Once she decided to refuse him residence due to actions committed by him to create a situation unsafe and in essence breaking any and all legal tenant rights to the property. (personal issues involving police not my business) She asked me to issue the eviction form per our lease and addendum agreement.

UPDATE: I consulted an attorney and I issued the 5 day eviction notice. My tenant handed him the notice since she was officially his landlord. The boyfriend packed up his stuff and moved once he realized that this notice was official and not just made up! Thankfully

5-day notice to vacate to tenant at will

This notice can be used only if there is no rental agreement, oral or written. This situation may occur if:

  • a guest refuses to leave;
  • the rental agreement has expired and the landlord has told the tenant that the contract will not be renewed;
  • a new owner has purchased the premises through bankruptcy, foreclosure, or sheriff's sale and has received a title terminating all rental contracts. (If the new owner is evicting a tenant after purchasing the premises in a regular sale and the tenant is on a month-to-month tenancy, the new owner must serve the tenant with a 15-day notice. Otherwise, the tenant has a right to live in the home until the rental agreement expires.)

This notice orders the tenant to move out within 5 calendar days. It does not have to give the tenant any other options. If the tenant does not move out within 5 calendar days after notice, the tenant is "unlawfully detaining" the premises.

With tenant at will eviction. It specifically applies to guests overstaying their welcome who are not on lease and do not pay any portion of the rents. My tenant has the rent automatically deducted from her payroll twice a month as she has a government position. I will definitely report back results.

It's in UTAH.... I'm pretty sure we have it covered. They have a fantastic site online OPAC for help with filing documents. We have issued him a 5 day vacate premises tenant at will notice and the tenant is going to hand deliver the notice. I hope he moves out without incident. Otherwise we will need to proceed with the court eviction process on day 5! 

Love the internet and the fact that so many states are starting to have the laws and regulations readily available online for research and review.
