@Alex Deacon,   Thank you.   it's good advise.   

I've also contacted her attorney  (appointed by Child services)  just to have another person in the loop.   I'm ok to keep the things an extra week or 2 if she can remove them herself as it would take my as long to arrange for it to be done myself. (as well as save the dumpster/labor costs)

Thanks,   I'm mailing this letter today....  

"When you vacated the premises at ..................... on July 20, 2020, you left a large amount of personal property, including but not limited to bedding, clothing, and furniture.

Unless you remove all items from the premises no later than Wednesday August 19, 2020, all items may be disposed of.

Please contact me as soon as possible to arrange pick up or send a letter authorizing me to get rid of all property as I see fit. I’ve included a SASE for your convenience.

Hi all,   

I’m hoping you can offer some insight to my rights and responsibility to the tenant in this situation; (Property is in PA)

- One of my units was raided by SWAT on the evening of July 16.

- Due to the neighborhood protection ordinance Tenant was removed/locked out by me at our mayor's request on Monday July 20th.

- Tenant's own attorney said instant eviction by the city is legal and she has no recourse. 

- Tenant gathered some items on the 20th, I’ve contacted her several times via Facebook about when she might be able to get the rest of   her stuff. She has no car and is currently living with friends.

 - July 30th was the last time she replied saying that she would TRY to get more things out.

- Today's requests for a date she can come remove more items have not yet been returned but that is not out of the ordinary for her.

- I have contacted my attorney today but have not heard back yet.

My primary questions are:

How long do I have to store her stuff?

Is there any other notification or other process I have to complete before I remove here stuff? (assuming the time requirement has been met)

Anything else I should be aware of in your experience?

@Nathan Gesner at this time they are only legally guilty of being a nuisance.

I was approached by the neighbors on the Friday preceding the Monday thy went to the city. After talking with the code enforcement office it sounds like they are generally bitchy neighbors who are never happy and he knows that. 

  I did convey to the neighbors that I could not fix a problem I was unaware of. I had made plans with the tenant to do  inspections every other week  to ensure there we no other occupants not listed on the lease.   Neighbors had claimed an additional 3 adults and 2 children were living with the tenants.   Water usage and visual inspections during repairs support the tenants claim of just themselves and their own children. 

It's just a sloppy mess.   I've since called the tenant and let them know the city will remove them via lock out if there is anymore trouble and I encouraged them to relocate.

I have a tenant who has been in place for 3 years and a few weeks.  May 1 I signed a 6 month renewal. 


1 week ago today while I was waiting for appliance delivery the neighbors decided it would be a good time to tell me how much of an issue the tenants had been. Monday they went to the city. 

City has declared these tenants a nuisance property. I have been sent a certified letter of such. 

From what I'm reading I can serve a 10 day notice to vacate for conducting an illegal act.

They owe partial rent today, so I'm hoping to post/deliver when I collect rent.

@Max T.  I do want them out.

They are my problem child so to speak... they fight often, slow pay and keep the yard a mess....

But they have been there 3 years and do pay.

I'll draft another eviction notice for June 1and address the fact that they should leave and hold over will be charged at a much higher rent.  I'm trying to price them out so I don't actually have to fight to evict them.

my tenant has a yearly lease which will expire April 30th 2018. I served a notice of nonrenewal, they asked if they could stay, I said we could discuss at a later time but they should plan to move. 

I am almost certain they plan to hold over, their rent is currently below market rent so I'd like to charge more. It's my understanding that in PA a yearly lease that is not renewed would revert to MTM.

I know I probably should have included hold over langue in the original lease or on the Notice of Non-renewal but it's too late for that now so I need to determine

a. should I serve another eviction notice?

b. Can I raise potential May rent now or should I just cover that on an eviction letter. 

Would an eviction have to be hung on their door or can I handle it via postal mail, texts and conversation?

Assuming you have at least 1 month's security and you know them to be pretty responsible, I'd let them go MTM. 

I agree it not ideal to have a loud, dirty or slow-pay tenant on a year lease. It's just too hard to get them to leave.  

Raise the rent 4% or more and let them stay

Could it be estimated as original borrowed amount + interest that would have been amortized or is it likely to be some nightmare # like  principal + interest + penalties + interest on penalties?
