So it has to go before the court to get approved. Everything. So the listing agent's contract, your contract with the seller etc. The court has to approve the whole thing. The court even approves the price. Once approved by the court the lender will approve, and I believe it goes back to court one more time to give the final seal of approval. SOMETIMES I've seen the trustee put a hefty fee on there for themselves. I don't think it's much of a big deal. Certainly a bit more work, but we've done several of them. You need a good BK attorney that's ok to work with though and in my opinion not all BK attorneys like short sales.
