@Jeff K. If the current mortgage is a low interest, it is even better to create a seller finance note at a higher interest rate and cash flow more.  If the interest rate is not at it lowest possible, I would refi first.

I would seller finance the property via a wrap and take out the worries of being a landlord.

We have been advised that Stewart title will not provide title insurance on foreclosures occurring after March 1, 2020 until January 1, 2021.  They relate this policy on the ban on federal foreclosures (CARES ACT).  We expect other underwriters to put this policy in place also.  Make sure you take this into consideration if buying a property the subject of a foreclosure during this period.

The best way to save thousands on legal fees is to work with, and have your closings with, a fee office - ie an attorney owned title office.  Much of the "legal work" involved in a real estate transaction is a duplicate or partial duplicate of the title work.  The benefits are too numerous to list - but, always try to direct title to your preferred fee office.

Greg H put it best -- "Homestead laws and the Homestead exemption for property taxes have nothing to do with each other".  Declaring homestead with the county for tax benefit does nothing in regard to establishing the property as homestead per Texas homestead laws.  The title company is 100% wrong to say you have to be present at their office.  You must be present at a title office, a mortgage office or a law office.  No need to travel.  I have a law and title office in Texas.  Reach out to me and we can get you the real answers and resolve this mess for you.
