Where did you get this list? If you are buying it from a list broker, then yes its possible it is occupied because those lists you buy are typically old info. I go directly to the county recorders of deeds website and look for code enforcement liens. I click on any lien that has the word of the city, county or code. I look at the source of the info the list brokers get their info from. It is current and more accurate.

I never buy any lists because of the reason you stated. I always generate them myself. I go after probate, tax deed auctions, vacant houses, code enforcement, out of state owners etc. I get the info directly from the sources.

I am looking for some insite into buying a house that is heading for a tax deed auction. I found a duplex that is heading for the tax deed auction in Florida next month. The owner is now deceased and I could not find any probate of will cases on this person. I generally contact the owner before the auction and negotiate a deal with them. 

Is there any way I can close on this deal? And if so how?

I look for tax deed auction, code enforcement, probate properties all on the county assessors and clerk of courts websites.

Yes you will have to tell the sellers that you are an agent, but you are talking to them as a buyer. It also opens up the doors to market other investors properties to your buyers list.

Find deals first. It is easier to find buyers than sellers. Once you get a contract on a property go to the MLS and find all the cash buyers in that neighborhood for the past 3 years. If they are already buying in that neighborhood then they may like your deal if it is good enough.

Also there are programs you can subscribe to get a list of cash buyers all over the country.
