Find out from you local reia some local contractors that do awesome work and are not expensive. Also have your contracts read the job needs to be done by such and such a date and anytime after will result in a payment decrease. NEVER EVER pay them before the work is DONE!!! As a new licensee I would pick the company with a strong training background. Learn the business inside and out. After you have some experience under your belt then choose a firm that fits your needs and your economic parameters. Make sure they are investor friendly and that they are ok with their realtors being investors as well. You are the owner the contract is with you!!!!! As far as their deposit why would they owe you anything? They have keep up with their rent and taking care of your property. I am actually shocked that you feel entitled to more of their hard earned money. It is not their fault YOUR PM died and should not feel the effects of it at all other than to send their rent checks to you or another PM. If this is actually what you feel you are entitled to then maybe you should rethink being a landlord because you can and will be sued. Think of it this way your utilities company requires a deposit to turn on lights or water. The admin stole money and the utility company "no" longer has your money. They call you and say hey we lost your money you have to give us more or we will shut off your utilities. How well would that go over?

You can get a VA loan and fix up the house. As long as you are transparent with everything why would it be illegal? Why would you hide it and give someone else money?

Ok so if you want to start a possible reason for the tenants to sue you then by all means keep their money. I would wait until the tenants are out. In the future on the lease state NO pets or if you do have pets with the 24 hr notice they must be either in a kennel or removed! None negotiable forget about tenants any repair ppl would not enter with a nasty animal. The animal is doing what it is supposed to do. You could however be sued for allowing a vicious animal around anyone authorized to enter the property.

Tenants could cause damage to your property and/or not get out on time. So do not push this issue with these ppl.

Let them know had it been brought up before today you could have worked it in, At this point the new owners will be taking possession and do not want it occupied!!! To late and I would not feel bad you could not have known.

My hang up is the eviction. He could have "worked" out something with the gf and landlord to not get that on record. Also does he have a lic. now? Seems the last few years he has had a run of "bad" luck. I would not want to have that run continue in my property.

Is she paying late fees? If she is always paying late are you giving her 3 day notice every time? What part of NY? How much longer on the lease?
