Note from attorney:

We ended up posting a letter of abandonment, gave the tenant 7 days to respond. And we will proceed with moving his things out if we don't hear back.

@Thomas S. Thanks for your response. 

 "new landlord cannot evict", The current lease states the agreement shall be binding to successors. Would our option be to give a 30 day agreement cancellation notice or can we evict immediately (after we take over and give 3-day notice) based on the non-payment?

@Richard Sherman Thanks.

Seller said he won't be available to go to the court, so I'll have to be present when he hangs the notice (equivalent to me hanging the notice). I don't know how that will play out though, giving that we don't own the property when I supposedly hung the notice.

We are closing on a property next week. Seller called he wants to evict a tenant for non-payment. Should we let him go ahead with giving the notice and proceed with the eviction (and then inherit the eviction), or should we wait until we close and file a fresh eviction?
