Supreme Court stated in 1934 that due process is not upheld "if a practice or rule offends some principle of justice so rooted in the traditions and conscience of our people as to be ranked as fundamental.”1 One would assume the principles so rooted include the right to be heard before an impartial judge, the right to challenge evidence and cross examine witnesses and to present a rigorous defense.
