In the case above you are in a bit of a grey area, but if you were able to prove that the cable was in good shape and that the cause of the issues was based on their actions alone, you would have a pretty solid case that the tenant is at fault and needs to pay.

@Braeden Hilbish Yes, you can use a 1031 exchange to build a barndominium on gifted land, but only through a build-to-suit (construction) exchange, which requires a qualified intermediary (QI) to temporarily hold title and use your $100K proceeds to fund improvements.

Also, since this is an FHA loan, there is 100% a due on sale clause.As others have mentioned, the legal advice I have received is that having the note/mortgage individually but having the property owned by the LLC creates a potential pathway to pierce the corporate veil in a suit.
