If a lender wants to enforce a Due On Sale, a Land Trust violates the DOS anyway so it is ineffective in stopping the Due On Sale call.Line 35 is always negotiable, but the seller needs enough to rent an apartment and move their belongs or they will become squatters which causes serious problems.

So I am going with option 2- and I would offer them 1 months rent penalty- instead of what they had previously signed in the last lease(2 months). and if they didn't agree to that they they could just pay until it's re-rented- which would likely either be longer than 1 month or probably 1 month's rent.

All items stored by Tenant must belong to the Tenant, and must be the Tenant's own personal possessions.

You don’t need to evict if the unit is clearly surrendered.If the family removed all belongings, returned the keys, and the tenant is clearly not coming back, that’s legally considered abandonment/surrender in most states.
