Katherine:  If the property was purchased properly and legally by the investor in 2024, then the previous owner's will not have a legal claim. 

I would go into the conversation with the current owner and ask what price they feel is fair and would move them to sell!

But is this not in a big way defrauding banks  lenders or property owners managers when they pull credit on this person. 

We owner occupied multi-families in the past that we have since sold and we currently own and occupy a single family home.

Hey @Patrick Shep Like KC said, if you are the owner of the property you are selling you can set up an LLC as a disregarded entity and get a DSCR loan for your replacement property.
