Jay a way I have seen to handle those types is to get a larger earnest money deposit upfront and as certain hurdles are met with the contract the amount of non-refundable EM increases in intervals as it gets closer to closing.

It should specify how much money is being transferred, for what period, how the money is to be paid back (interest only, principal + interest), at what intervals (monthly, quarterly, annually), and whether pre-payment is allowed, etc.

That's usually a good interval on termites to keep them controlled unless you see a specific problem beginning and need to address it.
