The interesting issue that the court dealt with which is instructive from an asset protection standpoint is related to the Alaska DAPT Statute itself, Alaska § 34.40.110(k), specifically states:“A court of this state [Alaska] has exclusive jurisdiction over an action brought under a cause of action or claim for relief that is based on a transfer of property to a trust that is the subject of this section.”In other words, the Alaska statute purports to have sole control over determining whether any transfers to the trust shall be deemed fraudulent.

Hi Vanessa,I've never heard it explained that way, but I guess that makes sense, since you are essentially using your buyer's funds to fund your deal with the bank.If you have a title company who has done these before, then you should be good to go.I wanted to clarify that the bank's title company will be emailing everything to your agent, so just be sure to tell your agent that you wish to sign everything at YOUR title company and ask for all of the closing docs and wiring instructions be sent to your contact at your title company.I don't explain the details of the simul close to the agents or the bank's title company.

She's been a great tenant always paying on time over the last year so I've instructed my management company to work with her.I like the idea of extending the lease a year and spreading those payments out over that extra year lease, I've instructed my PM to do this in cases of good tenants losing their jobs.
