The Pub refers to the "true" depreciation recapture, i.e. depreciation taken over the straight-line method which does not exist anymore except for very old properties.What we casually call "depreciation recapture" is properly called "unrecaptured Sec 1250 gain" which is straight-line and not subject to that rule.

The entity cannot appoint an attorney in fact (unless specifically authorized in the typically non-existent formation docs), so if the Manager or Members appoint via Resolution the POA is redundant.

It just so happens my experience with section 8 has been horrible-- stereotypes exist because people are really like that, not everyone.. but some are.. she is incredibly rude, verbally abusive to us, constantly complaining, quick to say she is going to sue us--and gosh, it's everything people warn you about-- I got!
