You do win if you can take a point or two for the consultant.

With no previous move-in report or photos, and the previous owner being deceased, you'd be fighting a battle that you couldn't win (in my opinion). 

A duplex property came onto the market for 200k yesterday.  I went to see it first appointment at 8am and submitted an offer at asking price.  My agent said it's in an estate and we'll need to wait for 3 approvals bef...

My guess is that unless you could show substantial damage you'd be hard-pressed to win this in court if they wanted to make an issue of it.
