I was in a similar spot when deciding to move away from single family.

Could a landlord potentially have a small amount of say peeling paint in a safe spot to intentionally fail and get around the mandate.  

It is in that order, never let them sign with no certified funds in your hand, if they don't pay you end up in a tough spot.
