I need some answers , I'm here in Hawaii and have a mortgage company that has not been recorded as a lein holder , not listed as a lein , however my original lender has released title or deed back to me . So my question is who has the rights to my property ? Me or the mortgage company not listed as a lein , keep in mind that my mortgage company was countrywide after the first one as well as it has been sold to Bank of America who is not listed as well .

Hi @Vanessa Duarte,

MERS is a database that allows banks to sell/transfer loans without additional recording fees.  The bank can change the MERS database for less money and less hassle than recording a new mortgage at the County level.  

If the title search indicates a lien is recorded by MERS then Countrywide/Bank of America likely updated the MERS database to indicate Greentree is now servicing the loan.

Good luck getting any timely info from Greentree.  My experience with them is terrible.  I once requested info through the secure email service on their website.  Over a week later I received an email stating that they would respond within 4 weeks.  About 3.5 weeks later I received a letter in the snail mail stating they were unable to answer my request through email due to confidentiality and I should call the service department.  I hope to refinance soon with a lender with better customer service.
