How many of you giving advice on evictions have ever done it here in TEXAS! From your answers here it appears to be none of you. The first duplex i bought i had to evict a tenant. Having gone through the Whole process it wasn't bad at all.
For this situation, I am going to assume you have a legitimate reason to evict. Most counties in Texas require a 3 day demand notice some counties require a 10 day notice, find out what your county requires. Give tenant written demand notice. Assuming 3 day notice requirement, after 3 days go to county court house, file for eviction, pay fee usually around $150. You will be given a court date usually within 10 business days. Show up to court without a lawyer plead your case, win, and the judge will usually give you possession within 3-5 business days. Along this process most tenants who don't have a case will leave, most before the court date. In the few cases they don't leave after judgment you then file for Writ of Possession and a constable will meet you at the residence to clear out the house of possessions and change the locks. Usually from start to finish takes less than a month.
If giving someone $500 to move out works for you, great but if not then the court system is landlord friendly in Texas. BTW since 2003 and that eviction, I have never had to go through that again. I have issued many demand letters and usually that was enough to either get the issue resolved or they moved on before the next step (court date) had to be accomplished. Good Luck.
