BK and Manufactured Homes

This is an informational post. One thing to be aware of is how a manufactured/mobile home is treated in bankruptcy. While most think BK is a federal standard, it varies state by state. I had a note in South Carolina where the property was manufactured home and as part of the BK they put the home as personal property not real property in order to cram down the first. While most say a 1st cannot be crammed down, there are ways where it can be in a Ch 13. This is one of those examples. Just wanted to share.

@Don Konipol if they affix a manufactured home to a foundation and remove the vin on it- it then falls under real property according to my attorney
