Buying a rental property during an unrevealed eviction.

We were about to get a closing date for a deal on a side by side rental in southeast Michigan, when we found out that the owner was in the eviction process with one of the tenants. They havent paid since November, and we put an offer in December 15. The real issue is, we found out March 25 through a google search!! The realtor never said a word when she sent us the tenants leases. We discovered it when trying to figure out why it was taking so long. Our question is, can we recover our inspection money from the owner, since we would have never even made an offer on a property with an eviction going on.

Why not just postpone settlement until after the tenant is out, and make sure that the vacated apartment isn't destroyed? This gives you an opportunity to start fresh and screen your own new tenants.
