They moved out on June 1st. They decided to not pay rent for May and avoid talking to us at all cost. Finally we put our foot down on the 15th when we are able to send a 5 day notice and they said they were leaving. Were were ready to offer cash for keys, so i made them sign a paper stating they were breaking their lease and forfeiting their Security deposit with the place in swept condition. They are gone though and I am fixing up and renovating the place now. :) They did not leave it in bad condition. But we inherited them and knew we were going to have to upgrade the place anyway when we bought it. 

This forum was super helpful when I needed it. Thanks for all the input and advice.

Just an update. So they got rid of the dog and have not been home, including all three kids, for two days straight. They stopped by today for five minutes, but we think they may be leaving as they told us they would be before the end of the month. Still haven't signed papers and still haven't given us a direct answer. 

I think they might have moved a bunch of stuff on Friday while we were at work. 

I can only hope. Cross your fingers for me.

Thank you all for your inputs. I seriously appreciate it. 

So we called the lawyer with the advice to let them break lease etc etc. Go up there to talk and immediately he starts with the threats and insults. Just like the lawyer said, to get his *** in gear we told him we had a recording of him threatening us and i pleaded that we needed to talk before we file a report. He proceeded to say things like he "sees the strange packages we have?" and how "we smell like pot?" I dont want to be rude, but i dont smoke or sell drugs. I work my *** of for a living. I kept my calm and told them we have accommodated a lot and want to get this settled and avoid court at all costs. 

He escalated and we left. I think the comment about calling the cops got to him.

The MINUTE we left his wife called and asked if we would come upstairs and chat with them at the table and actually talk. SO we did. BUT we had recorded every single minute of the conversation as well as them consenting to letting us into the house. they want to leave by March 1. I told them with 3 kids, if that is possible and they have a place by all  means do it but sign the termination paperwork to protect all of us. I told them if they want march 31st its totally fine. I am 100% fine with them staying till march 31st but the dog needs to be out by the end of the 20 day or we start eviction. This entire conversation was a 180. They agreed to go. Were asking the lawyer tomorrow the proper steps for them to leave early which don't leave us liable at all for them. As i stand this seems promising. 

I will update when we get the next step.

It helps to understand that no matter what time will get rid of them. I am very patient, so we will see how it goes from here.

We spoke with our lawyer this morning who advised us two different things. Go up and try and reason with him one more time, having him sign the noncompliance form as well even though we have sent one in mail today. He also said that we should ask them if they want to leave by April 1st, and have them sign a terminate vacancy paper so that they have documentation letting us and them know its over on April 1st no matter what, they have to be out. 

I am nervous to go up there and talk to them but the lawyer said since recording the conversation is absolutely not illegal in our state with one party(us) consent, that we should record this one as well, and call the cops if he threatens us again using the first recording from yesterday as evidence as well. Being on his last week of house arrest, he will not want the cops involved, so I am assuming he will be calm. I hope. 

If they do not want to get rid of the dog and do not want to move by April 1st , then the eviction process will be started the minute they have their dog for 20 days, and his car is still in the driveway with a noncompliance, and he's still smoking upstairs. I have pictures of the butts and can absolutely take one of him smoking as he's in the window doing it 12 times a day for us to plainly see.

@Sterling WhiteI totally would, but we are going to discuss our options with the lawyer tomorrow first. Then decide what option is best to go with.

@Missy H. It is over in four days, so hopefully we will see something change and not have to do that at this time. But we definitely should have when we purchased the place. We were really blindsided by the situation. 

@John ThedfordWe did look this up before he had recorded the conversation. One party consent is needed, but even if its inadmissible or something we cannot use, he did lie to my husband and put words in my mouth once before. It was more so I could hear every detail of the conversation. 

@Gino BarbaroI am home till 330pm on Mondays before work (typically we work full time day shifts except for my Monday), and I have been constantly seeing people in and out of the house in five minutes. That and the camera hooked up has bothered me. With him getting "off of house arrest" this week, I am so nervous its going to get worse. i'm absolutely suspicious, but I have been really scared they will try and hurt us. Can I contact with no evidence? Your reply meant a lot. I am doing everything I can to be professional and keep it a business association only. They realize this now that we have actually put the lease in affect, and are understanding they are tenants not owners I hope. 

@Robert Nason The patience I and my Husband have is unreal. We can keep a very calm cool demeanor in front of them and during these stressful conversations, but when were just in our apt we are really struggling to keep calm. I hope we are showing them we are not playing games or trying to hurt them, rather just uphold the contract they signed a year ago.

We are doing our diligence and sending the cure or quit noncompliance form tomorrow. I wrote it and printed it after the conversation earlier Using the LL Tenant handbook from RI. 

House arrest is real sadly, and its on his record as well. Haha, weird thing is, he tells us that since WE have moved in that weird stuff has been happening.

Hello everyone, and thank you for the replies. 

Very helpful, and extremely calming to hear this is somewhat normal. 

*update* We have been using the warmish weather to clean up the backyard and remove some stone. As we were outside, his wife came home and asked if they had to get rid of the dog. We told her we received no notice and were not alerted to any type of dog being brought home, and yes it would have to be removed due to the lease violation. She said they never signed a lease with us, and she absolutely KNOWS the lease carried over from the previous owner. So we reiterated this and she said well fine then, were moving next month but she wants her deposit back. I told her it is absolutely fine to break the lease, but we need 30 day written notice to receive the deposit back. There was no animosity in this conversation. Both parties were absolutely calm. 

After she got upstairs I can hear the husband yelling at her that we do not know who he is and what were dealing with. Hows its unfair we have a dog but they can't have one. they cant take out deposit, who do they think we are. 

This sounds like a 5 year olds tantrum, but i kid you not. 

Honestly, if she had discussed it with us and we added a clause to the lease it wouldn't be so much of a problem. But now I've been threatened and insulted numerous times and I do not want another 4 months of this. I feel sick whenever I am home. I am afraid to be in my house, and i am afraid if we leave our house will get damaged.

I guess one of my main frustrations is that we have been really great to these people. the second they have texted me about an issue, we have dissected the issue and fixed it within three days. All things, like they did not like the faucet because it had a weird screwy problem, fridge was broken, etc. 

Additionally we live in a snowy area, when we had a snow storm they had asked where to park due to parking bans. we ALLOWED them to park in the driveway as long as there was a ban and we were home. Not even so much as a thank you. Its like they deserve the special treatment. 

I hate to be so negative, but we gave them the benefit of the doubt. They have now laughed in our faces and walked on us to the end of the road. I am just glad we can potentially catch this and allow them to just go. We loved this house, and looked at about 100 others before finding it. Sadly, with a year lease we couldn't ask them to vacate before moving in. I wish. Lawyer and mail sent tomorrow, just in case they decide to try and walk all over us with that "were moving anyway" crap. 

Anyway thank you for your help and any advice given. Its nice to feel less alone in the situation as terrible as that sounds.
