Is your deal currently under contract with a closing date and where are you in the HELOC process on the timing for getting your funds?

I know lenders where you don't need to worry about two years of rental income or your DTI ratio. As info.

I am a lawyer but cannot give legal advice. :-) But, what I would say is to check witH the Florida Secretary of State on requirements and you do not need to pay a CPA/Attorney to do it (although it should not be expensive to go through one for simple paperwork(. I know that it can be done on an expedited basis in Florida in 24 hours as I did one. So, you may not want to set it up at all unless you get a property under contract and think you will close. If you have a decent close period, you can set it up from time of exeucting the purchase contract to close. Just make sure if you contract in your name, you can assign the contract so you can close in the name of your newly formed LLC. Good luck!

I work for a national commercial mortgage broker.  I echo the sentiments that it is difficult to get financing on land only.  If he wanted one loan to purchase the land and do the construction, he will have much more options, particularly with prior ground up hotel experience.  Please email me and I can walk you through it.  Thanks.
