Thanks, All, for the suggestions. I can see that I need to revise my lease language to note that any payments go to late fees first.
As of today, the tenant hasn't paid any October rent. I delivered the Demand for Rent and Eviction Notice on the 8th. He started firing texts at me that I can't evict him and he'll just tell the judge he has lots of expenses due to his custody case. (I didn't respond. He seems like he could be a bit of a nut case.) After the 15th I can get the Writ. Can't wait to get him out.
On the up side, contrary to some things I've seen in these forums, in NH if you work out a payment agreement and the tenant doesn't comply, you don't start at square one; you just need to file an affidavit of noncompliance and the process goes from there.

I have a tenant who has been late with rent payments since August. He's currently paid through Sept, but hasn't paid Oct. He has racked up $360 in late fees. He said Oct rent is 'in the mail' and that he can't pay the late fees until next month. (That's what he said last month.) I've sent him the pay or quit notice and as of today I sent the eviction notice. If he doesn't cure by Oct 15, but does pay the Oct rent, can I proceed with eviction based on non payment of late fees? I don't see anything about this in NH law. I can consult my attorney, but thought I'd start here.

Thank you, All, for your responses. It's interesting to see all the various approaches you suggest, and not one clear approach. I have decided to send the tenants a ‘Residential Lease Agreement Addendum – Termination of Obligation’, which would end the the rights and obligations of the woman based on mutual agreement of both. The tenant wants me to just issue a new lease without her name on it, but since they still have at least one upcoming hearing on the domestic violence/parenting arrangement, I want to keep it all above board. The guy doesn’t want to have her sign the agreement and wants to call her leaving ‘abandonment’. I explained abandonment would have apply to all tenants (so him as well), not just some (as I understand NH law). It’s quite an education to see how this plays out. I figure, since he has the income and pays the rent, it’s in his interest to get her off the lease, but it doesn’t really matter to me, unless she ends up being able to return to the apartment and he has to leave. Then, we’ve got a whole different ball game.

My tenants, an unmarried couple, had a domestic violence issue and the court says the guy gets to stay in the apartment. (She was the abuser.) He wants her off the lease, which is fine. But, am I required to return half the deposit to her and have him pay her half? He's the one who has a job and pays the rent and paid the deposit. It seems I should just leave the deposit as is, but I like to go 'by the book'. Neither party is asking about it, nor has the court provided any directive. It's a new one for me, so I want to be sure I'm doing this right.

@Account Closed my intent would be to add it to their leases when they are up (November 2015 and May 2016). It can get pretty wild in this state with all the signage. Since the exterior of the property doesn't go with either unit in particular, there could be some real carnage. Oy!

Is it possible to disallow signage on the rental property, for example political signs supporting a candidate or an issue? I'd like to include it in my leases and head off an issue that is likely to come to a boil when the presidential election heats up. Tenants in one of my duplexes are already squabbling to the point of near violence. But, would not allowing signs be a violation of my tenants right to free speech?

I use, and like, mysmartmove as well. It is from TransUnion. The reports from the major three credit companies can vary.

Marcia, it sounds like you've been handling your tenants similar to the history of my tenants. Can you tell me more about this: However, each change comes with a price to compensate us for our time and expenses. What do you charge each time you need to re-do the lease?

Thanks All. This is helpful. This gives me some ideas for things I can do. I do want to work with them; they're 20 somethings, work hard and pay on time. Good to know this happens with others and you've got things in place to handle this situation.

I inherited tenants when I bought a duplex last Oct. One unit has three unrelated singles who share the rent equally, pay with one check and are all three on the lease. All was well until recently when one decided to move out. He found a replacement and thought that was it. Long story short, I did a background check on the new person and all worked out. A month later, another one of the tenants wants to move out and doesn’t have a replacement. I explained that the lease is a legal contract and they can’t just come and go as they please (which I’ve learned the prior landlord did allow). The lease is up end of Nov and I wonder if I should just get them out so I don’t have to deal with this going forward. But, a) Dec isn’t a great month to find a new tenant, right? b) How do I avoid multiple single roommate situation going forward? The duplex is very large and has 2 to 4 bedrooms depending on how you use the rooms. I can’t say max 2 people per bedroom since that could potentially be 8 people! I’m wondering if limited the parking to two cars would be the best route. Suggestions are welcome.
