@Marc Andressen free advice on the Internet is worth what you pay. I think if you buy as tenants in common a TIC with shares issued then you can each go your own way at sale. You need a good accountant / attorney

If you 1031 you won't be able to go into REITS directly. A move into a REIT requires a process called a 721 exchange. Once you have moved from the real estate into the reit you no longer own real estate. You own a security. So, many of the benefits of real estate ownership are no longer available. A high price to pay for someone with a buy and hold mindset. Certain TIC syndications and Delaware statutory trusts round out your available real estate options


Could legally 1031 into a Delaware Statutory Trust AKA DST for a similar result...

Commercial. Did residential for 20 years and done with toilets, tenants and trash... but hard to answer your question without more context of your overall portfolio, investment objectives etc...strictly for beating inflation residential is probably the better bet as rents will adjust more quickly.

Dan what is your investment objective and time horizon? Generally NNN increase in value when interest rates decrease and they interest rates seem to be heading the other direction but if you are planning to lock in for 10 years and sit on the cash flow you may not care about fluctuations in value...

Update...the tenant offered a generous buy out 80% of rent and one year of taxes...snafu I’m hitting is my lender on the property would have to approve any early lease termination and wants me to escrow proceeds. Worried about a big tax hit with pre-paid rent but proceeds stuck in escrow. Initial prospectes for rerent not great. So far just one lowball offer from Dunkin Donuts. Working on it

Just found out that Santander is closing a branch I own with a couple of years remaining on their NNN lease. Anyone have experience with similar situation? With they continue to pay through the end of the lease? Will they offer to buy me out? If yes what would be typical. E.g. if they would owe $150,000 in rent and taxes will they offer me $100,000?

@Abhaya Pothina. Great questions! Curious to hear other answers as well. I took a class in negotiations and they talk about the BATNA the best alternative to a negotiated agreement. If the Tenant doesn’t Renew what are your options and what will it cost you?
