I have invested in individual performing notes, partials, funds and did a successful JV on a re-performer as an investor primarily for the educational experience. I enjoy the niche and the flexibility it offers to spend as much or as little time with it on an on-going basis.

Part time real estate and notes investor. Bought my first investment property in 1992 and first note in 2015.

Set up Trustworthy Funding, LLC in August of 2019 for investment or referral of any type of real estate note, PN or NPN, 1st or 2nd lien. Still invest in property as well and enjoy a diversified, self-employed lifestyle that includes part time software sales.

First the disclaimer. I'm not an attorney and I'm trying to provide legal advice. This is just my opinion. I did check with an attorney about a couple of the states in which they are licensed to practice. You can double check but they said OH (already mentioned above), KY and IL require licensing for note owners and that includes each and every entity so if you purchase using 2 LLC's then they both need to be licensed.

I think it's fairly safe to assume that if you file foreclosure as an example, any good opposing counsel will check to see if the plaintiff is licensed and it would be easy for a judge to say "no license, I'm not hearing this case".

I have to give @Chris Seveney a good reference on this. I can confirm from a partial Investor standpoint and having done business with him that the agreement is well written, clean and the payout process and the default resolution options are very fair. The transaction process was very smooth as well.

I used Franco Barile with Sottile & Barile
