@Eric Nimmo - absolutely. There are markets like San Jose that are actively encouraging ADU construction as a solution to the housing shortage. It is a win, win, win. The local jurisdiction gets the housing supply, the homeowner gets income, and a tenant gets a good rental rate (generally ADUs are more affordable than the regular market).

@Pavan Sandhu - 3.7% interest on a fixed 30 year can’t be beat right now.


Your recommendation might make sense when I finish the ADU project but I'll have to wait and see.

I'm using a HELOC for my project here I n downtown SJ. It made the most sense since I have such a ridiculous low mortgage rate right now.

ADU all the way. The numbers make way more sense from a cashflow and ROI standpoint.


Plus, depending on where you live in the Bay, there will be more opportunity for appreciation in the future.

I am building an ADU in downtown SJ. I considered buying a SFR rental in Sacramento with my HELOC but it just makes no clear sense financially. I think I am way better positioned with an ADU here.

Most leases have no fault clauses that cover natural disasters and other acts of god. It is unlikely that a landlord has any liability if they have a solid lease written.

@Nathan G. Is spot on. Your lease should cover this contingency. It would be treated as a holdover. Your leverage is charging them a large rent per day and, if needed, eviction.

I would advise talking to the tenant. Inform them, in writing, of the issues and consequences for their extended stay. Good luck.

Talk to an attorney and work with them to file a claim with your title insurance company
